What qualifies

68 O.S. Sec. 3635(A) frames the in-state incentive (excluding above-the-line personnel) as a MAXIMUM of 30% of the qualified production expenditure amount, with wages paid to non-resident crew (excluding ATL) at 20% on or after April 1, 2023. In practice OF+MO administers a 20% base on goods and services, stacking to the Sec. 3635(C) ceiling of 30% of qualified production expenditures. Every uplift is computed on the WHOLE qualified production expenditure amount, not on the spend that triggers it: +3% rural county (county under 250K population, 25% of main-crew principal photography days on location, excluding soundstage), +2% small municipality (under 25K population, 25% on location), +5% certified soundstage (25% of days at a qualified soundstage plus 3% of direct expenditures spent there), +2% TV episodic pilot / +5% TV series season (75% of the season filmed in OK), +5% multi-film deal, +3% post-production paid to Oklahoma vendors (minimum 3% of Oklahoma production expenditures, threshold only), +2% Oklahoma music. Labour rates: Oklahoma-resident ATL and BTL at 30%; Oklahoma expatriates at the earned rate; non-resident BTL at a flat 20%; non-resident ATL at the project's full earned rebate percentage, with qualified non-resident ATL payments capped at 25% of total qualified spend. At least one day of principal photography must occur in Oklahoma. Total project expenditures of $50,000 or more (Sec. 3634(C)). Apprentice hiring required: 2/4/8/16 by Oklahoma spend (Sec. 3637). Sec. 3633(E)(7), as amended by HB2374 (2025), mandates Oklahoma income-tax withholding at the highest statutory rate on loan-out payments for Oklahoma services. MUTUALLY EXCLUSIVE with the point-of-purchase sales tax exemption under 68 O.S. Sec. 1357(23) per Sec. 3633(F) - a production cannot receive both, and any exemption already taken must be fully repaid to the Tax Commission before a rebate claim is paid.

Uplifts

Rate bumps that stack on the base program, up to its published ceiling. Uplifts are the most commonly missed money in any program, because qualifying for one is usually a location or scheduling decision made long before anyone is thinking about submittal.

    Qualified expenditures on music production, recording, mixing or composition, or on licensing of Oklahoma music; the 2% is paid on the whole qualified production expenditure amount.

How to apply

Submit the online Eligibility Application via the Oklahoma Film + Music Office (okfilmmusic.org/incentives) at least 45 days before principal photography. Meet 50%/100% proof-of-funding and insurance benchmarks; include OF+MO on call sheets; file Final Application + CPA Independent Accountant's Report within 90 days of last OK expenditure. Register as an OMES supplier for payout.

The rule to remember

20% base on goods/services, up to 30% stacked (Sec. 3635(C) cap). Resident ATL+BTL 30%; non-res BTL flat 20%. Cannot be combined with the Sec. 1357(23) sales-tax exemption (Sec. 3633(F)).
